These Terms and Conditions constitute a public offer agreement between VIA Continent and the customer. By accessing our website, placing an order, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms and Conditions.
These Terms apply to all purchases made through the VIA Continent online store. If you do not agree with any part of these Terms, please do not use the website or place an order.
Seller means VIA Continent, operated by Individual Entrepreneur Vadim Mogolyuk Petrovych, Tax ID 3197317633, registered in Ukraine.
Customer means any individual or legal entity that visits the website, places an order, or purchases products from the Seller.
Product means any item offered for sale on the website and selected by the Customer for purchase.
Website means the VIA Continent online store through which Products are displayed, ordered, and purchased.
Order means a Customer’s request to purchase selected Products through the website checkout or through another sales channel confirmed by the Seller.
The Seller offers Products for purchase through the online store. The Customer agrees to pay for and accept the Products under the conditions set out in these Terms.
The agreement between the Seller and the Customer is considered concluded when the Customer places an order and receives order confirmation from the Seller by email, through the website, or by another available communication method.
The Seller reserves the right to update, change, or replace any part of these Terms at any time by publishing the updated version on the website. Changes become effective from the moment they are published.
The Customer places an order independently through the website checkout by selecting Products, adding them to the cart, and providing the required order details.

The Customer is responsible for ensuring that all information provided during checkout is accurate, complete, and up to date.
The Seller has the right to refuse, cancel, or request additional confirmation for an order if the provided information is incomplete, inaccurate, suspicious, or if the order cannot be fulfilled for any reason.
The Seller makes reasonable efforts to display Product descriptions, images, colors, sizes, specifications, prices, and availability as accurately as possible.
Product colors and appearance may vary slightly depending on the Customer’s device screen settings, lighting, or product batch.
Availability of Products is not guaranteed until the order is confirmed. If a Product becomes unavailable after the order is placed, the Seller may offer a replacement, cancel the unavailable item, or issue a refund.
All prices on the website are displayed in United States Dollars (USD), unless another currency is clearly shown at checkout.
Product prices may be changed by the Seller at any time without prior notice. However, the price of a Product already paid for by the Customer will not be changed after the order has been confirmed.
Product prices do not include shipping costs, customs duties, import taxes, brokerage fees, or other charges that may apply to international orders, unless such costs are clearly included at checkout.
Payment methods available for the order are displayed at checkout. The Customer agrees to pay the full order amount, including Product price, shipping cost, taxes, and any applicable fees shown at checkout.
The Seller’s obligation to process and ship the order begins after successful payment confirmation, unless another payment method has been agreed with the Seller.
If a payment is declined, reversed, flagged as suspicious, or not completed, the Seller may delay, cancel, or refuse the order.
Orders may be shipped to the United States, Europe, and other regions supported by the store at the time of checkout.
Shipping options, estimated delivery times, and shipping costs are displayed during checkout where available. Delivery times are estimates and may vary due to carrier delays, customs processing, holidays, weather conditions, or other circumstances beyond the Seller’s control.
The Customer is responsible for providing a correct and complete shipping address. The Seller is not responsible for delivery failure, delay, or loss caused by incorrect or incomplete shipping information provided by the Customer.
For international orders, the Customer may be responsible for customs duties, import taxes, VAT, brokerage fees, and other local charges required by the destination country. These charges are not controlled by the Seller and are the Customer’s responsibility unless explicitly stated otherwise at checkout.
The risk of accidental loss or damage to the Product passes to the Customer after the Product is handed over to the shipping carrier, unless mandatory consumer protection rules provide otherwise.
Upon delivery, the Customer should inspect the package and Products as soon as possible.
If the package is visibly damaged, incomplete, or appears to have been opened during transit, the Customer should contact the carrier and notify the Seller as soon as possible, providing photos or videos where possible.
Claims regarding damaged, defective, incorrect, or missing Products should be submitted to the Seller within a reasonable time after delivery.
Returns, exchanges, and refunds are handled according to our Refund Policy.
In general, unused Products in their original packaging may be eligible for return or exchange within 14 days, unless the Product is non-returnable by law, hygiene rules, customization, or its individual characteristics.
Products must be returned with all original packaging, labels, tags, accessories, documentation, and proof of purchase.
Return shipping costs for Products of proper quality are paid by the Customer, unless otherwise agreed with the Seller.
If the Product is defective, damaged, or incorrect due to the Seller’s fault, reasonable return shipping costs may be covered by the Seller after the issue is reviewed and confirmed.
Refunds are issued only after the returned Product is received and inspected by the Seller. Refunds are processed to the original payment method or another agreed payment method within 30 days after the Seller receives the returned Product.

The Seller is not responsible for losses, delays, damages, or expenses caused by incorrect information provided by the Customer, improper use of Products, failure to follow Product instructions, actions of third parties, customs delays, carrier delays, or force majeure circumstances.
To the maximum extent permitted by applicable law, the Seller’s liability is limited to the value of the Product purchased by the Customer.
The Seller and the Customer are not liable for failure or delay in fulfilling obligations caused by events beyond reasonable control, including but not limited to war, military actions, natural disasters, fire, flood, strikes, government restrictions, customs delays, carrier disruptions, internet outages, or other force majeure events.
By placing an order or using the website, the Customer agrees that the Seller may collect and process personal data required to process payments, fulfill orders, provide delivery, communicate with the Customer, prevent fraud, and comply with legal obligations.

These Terms are governed by the laws of Ukraine, unless mandatory consumer protection laws of the Customer’s country of residence provide otherwise.
Any disputes should first be resolved through communication between the Customer and the Seller. If the dispute cannot be resolved through negotiation, it may be referred to the competent court or authority in accordance with applicable law.
